GENERAL TERMS AND CONDITIONS OF SALE
1. Subject
These general terms and conditions define the rights and obligations of the parties in the context of the remote booking of services offered by our establishment: Cabane "La Douce Parenthèse", operated by the SCI MAJELI, whose registered office is located at 140 le Barou, 19360 COSNAC, registered under the number SIRET 103 022 984 00019, email address contact.ladouceparenthese@gmail.com, telephone 06.12.14.38.85. Location of service: 18 Impasse Camille Desmoulins, 19100 BRIVE-LA-GAILLARDE. These terms and conditions govern all steps necessary for booking and managing the reservation between the contracting parties. The client acknowledges having read and accepted these general terms and conditions of sale and the terms and conditions of sale for the reserved rate, accessible on our booking platform.
2. Booking
The client selects the services presented on our booking platform. They acknowledge having read the nature, purpose, and booking procedures for the services available on our booking platform and having requested and obtained the necessary and/or additional information to make their booking with full knowledge of the facts. The client is solely responsible for their choice of services and their suitability for their needs, and therefore, we cannot be held liable in this regard. The booking is deemed accepted by the client upon completion of the booking process.
3. Booking Process
Reservations made by the customer are processed via the online booking form accessible on our booking platform. The reservation is considered confirmed upon receipt of the booking form. Prior to any reservation, the customer agrees to complete the information requested on the booking form or request. The customer attests to the truthfulness and accuracy of the information provided. After the final selection of services to be booked, the booking procedure includes, in particular, entering credit card details if a guarantee or prepayment is required, reviewing and accepting the general terms and conditions of sale and the terms and conditions of the selected rate before confirming the reservation, and finally, confirming the reservation by the customer.
4. Booking Confirmation
Our booking platform acknowledges receipt of the customer's reservation by sending an email without delay. In the case of online booking, the booking confirmation email summarizes the contract offer, the services booked, the prices, the terms and conditions of sale related to the selected rate and accepted by the customer, the booking date, after-sales service information, and the address of the seller's establishment where the customer can submit complaints.
5. Gift Vouchers
Gift vouchers are valid for 12 months from the date of issue. They are neither refundable nor modifiable. The full amount of the gifted stay must be paid for at the time of booking. If the voucher is not used during the validity period, the amount of the stay remains the property of the establishment.
6. Cancellation or Modification by the Customer
Customers are reminded, in accordance with Article L. 221-28 12° of the French Consumer Code, that they do not have the right of withdrawal provided for in Article L. 121-21 of the French Consumer Code. The terms and conditions of sale for the reserved rate specify the cancellation and/or modification procedures. Reservations with prepayment cannot be modified or cancelled. Advance payments are non-refundable. When conditions allow, cancellations can be made directly with the establishment. All reservations are nominative and cannot be transferred to a third party under any circumstances, whether free of charge or for payment.
7. Weather Clause and Postponement for Inclement Weather
As the cabin is a wooden structure located in the heart of nature, the establishment reserves the right to modify or cancel your stay in the event of external events beyond our control, such as severe weather (storm or violent thunderstorm) or an orange/red weather alert. In this case, the sums paid will not be refunded, but a postponement will be offered within 12 months of the event, subject to availability. No other compensation may be claimed.
8. Consumption of Services and Image Rights
Any behavior contrary to public decency and order will lead the establishment to ask the client to leave the premises without any compensation. The client agrees to respect the internal regulations of the "La Douce Parenthèse" cabin, in particular regarding check-in time (5 pm / 11 am). Animals are not allowed for hygiene and safety reasons. The use of photos of the cabin for commercial purposes by the client is strictly prohibited without the prior written consent of SCI MAJELI.
9. Liability
The establishment cannot be held liable for the non-performance or improper performance of the reservation in the event of force majeure, actions of third parties, or actions of the client, including but not limited to internet network unavailability, inability to access the website, external intrusion, computer viruses, or in the event of unauthorized prepayment by the cardholder's bank. The establishment declines all responsibility in the event of theft or damage to valuables in the accommodation or vehicles in the parking lot.
10. Complaints
Complaints relating to the non-performance or improper performance of the services booked must, under penalty of forfeiture, be brought to our attention in writing within fourteen days of the departure date from the establishment: by email (contact.ladouceparenthese@gmail.com) or by post (SCI MAJELI, 140 le Barou, 19360 COSNAC).
11. Prices
Prices are indicated before and during the booking process. They are confirmed to the customer inclusive of all taxes. The total price displayed at the time of booking includes the tourist tax collected on behalf of the City of Brive-la-Gaillarde. Unless otherwise stated, additional services are not included in the price. Prices include VAT applicable on the day of the order.
12. Payment and Security Deposit
All bookings must be paid in full and in advance. Accepted payment methods are Credit Card (via the secure Stripe platform) and Holiday Vouchers (ANCV). The establishment has chosen elloha.com / stripe.com to secure online payments. To mitigate potential damage or theft (as the furnishings are high-end), a credit card authorization is taken at the time of booking. The client's bank details are stored securely to allow for the cost of repair or replacement at the new value in the event of damage discovered after departure. Any misuse of the sanitary facilities (wipes, etc.) resulting in a blockage will be subject to a flat-rate unblocking charge. La douce parenthèse can generate certified electronic invoices.
13. Privacy Policy and Bloctel
The information processed is intended for the establishment, elloha.com, Stripe, and its partners. The customer has the right to access, rectify, or delete their data by contacting: contact.ladouceparenthese@gmail.com. The customer is informed of their right to register on the Bloctel telephone marketing opt-out list.
14. Agreement on Evidence
Entering the required bank details, as well as accepting these terms and conditions and the booking confirmation, constitutes an electronic signature which, between the parties, has the same legal value as a handwritten signature.
The computerized records stored in the computer systems of elloha.com shall be considered proof of communications, orders, and payments between the parties.15. Force Majeure
Force majeure means any event beyond the control of the parties that is both unforeseeable and insurmountable. Apart from the weather events mentioned in Article 7, neither party shall be held liable for any failure to perform resulting from a force majeure event.
16. Dispute Resolution, Mediation and Jurisdiction
In the event of a dispute, after attempting an amicable resolution, the customer may contact the consumer mediator: MTV Médiation Tourisme Voyage - BP 80 303 - 75 823 PARIS CEDEX 17 (www.mtv.travel). In the event of legal proceedings, only the jurisdiction of the court of BRIVE-LA-GAILLARDE is recognized.
17. Entire Agreement
These terms and conditions constitute the entire agreement between the parties. No general or specific terms and conditions communicated by the customer may be incorporated into these general terms and conditions. The applicable version is the one in effect online on the date of booking.
